Commissioner of Deeds

A Commissioner of Deeds is a sworn public officer that is Appointed by the City Council in and for the City of New York and serves a two year (renewable) term.

 

He is legally appointed to office to exercise the governmental function (anywhere in the five boroughs) of ensuring that various business matters, including witnessing and authenticating document signatures, are authentic. This includes having the power to take proof of execution and acknowledgement of all written instruments; this includes any deed, mortgage, lease, conveyance, or other instrument.

 

Further, the Commissioner of Deeds can facilitate affirmations, attestations, witness the signing of agreements, letters or other legal or commercial documents under seal; those documents can then be recorded in the county clerk’s office. The Commissioner serves as an impartial legal witness to facilitate the workings of commerce and law by lending credibility to certain sensitive signed instruments. He assures documents of all types, legal, contracts, insurance, patents, and others, are not signed by an impostor. 

 

By statute, a Commissioner of Deeds may administer oaths or affirmations to a city officer, member of the legislature, to a military officer, election inspector or others. Attestations of a Commissioner of Deeds embrace full faith and credit, according to the US State Department, in countries outside the United States that are parties to the Pan American Protocol on Powers of Attorney. The Commissioner of Deeds may be appointed for a foreign country, to certify to the existence of a patent, record or other document recorded in a public office or under official custody in such foreign country.
